Court of Protection Lawyer – Newton Abbot

Are you a skilled legal professional with a passion for supporting vulnerable individuals? This is a standout opportunity for a Solicitor or Legal Executive with solid experience in Court of Protection work to join a dynamic Private Client team in Newton Abbot.

The Role
You’ll take the lead on a varied and meaningful caseload, working independently while contributing to a collaborative and forward-thinking team. Your work will make a real difference in the lives of elderly, disabled, and vulnerable clients.
Key responsibilities include:

  • Drafting and submitting Court of Protection applications, including Deputyship, Statutory Wills, and one-off decisions
  • Managing clients’ financial affairs in partnership with appointed Deputies
  • Preparing annual Deputy Reports and liaising with Costs Draftsmen and the SCCO for billing matters
  • Advising clients directly on financial and personal affairs, safeguarding their interests
  • Liaising with safeguarding teams to protect clients from abuse or exploitation
  • Supporting families, lay Attorneys, and Deputies with empathy and clarity
  • Collaborating with care professionals, social workers, psychologists, and financial advisors
  • Identifying tax, benefits, and care funding issues, including deliberate deprivation of assets
  • Handling property transactions and adaptations through the Court to meet client needs
  • Staying up to date with relevant legislation (Mental Capacity Act, Care Act, Deputy Standards) and case law (Re ACC, Re PW, Lumb)

Requirements

  • Minimum 3 years PQE as a Solicitor, Legal Executive, or CILEx
  • ACTAPS or STEP membership is desired but not essential
  • Strong client care skills and a genuine affinity for working with vulnerable individuals
  • Ability to manage a busy caseload with professionalism and compassion
